California eviction notice? Notify tenants before filing.

By the USMail.ai team, more than 50 years of combined expertise in printing and mailing

Statutes checked October 29, 2026

Direct answer: Your tenant is sent the written copy that California's service methods call for, and we print and mail it Certified or First-Class once you approve. Code of Civil Procedure section 1162 pairs mail with personal or substituted delivery or posting, so mail alone isn't service. USPS delivery times vary, so mail early enough.

What does this page cover?

This page is for the stretch after a California notice period starts and before you file an unlawful detainer case. The notice itself, usually a 3-day notice to pay rent or quit, is on California 3-day notice? Send it Certified. Read that page first if you haven't served the notice yet.

Can mail alone serve a California eviction notice?

No, going by the statute's list. Code of Civil Procedure section 1162(a) says the notices required by sections 1161 and 1161a "may be served by any of the following methods": (1) "By delivering a copy to the tenant personally"; (2) if the tenant is absent from home and work, "by leaving a copy with some person of suitable age and discretion at either place, and sending a copy through the mail addressed to the tenant at his or her place of residence"; or (3) if no such place or person can be found, "by affixing a copy in a conspicuous place on the property, and also delivering a copy to a person there residing, if such person can be found; and also sending a copy through the mail." Every method that uses mail pairs it with another step. USMail.ai handles the mailed copy only; the other step is yours.

Which California notices does section 1161 cover?

Section 1161 lists when a tenant is guilty of unlawful detainer. It includes staying after the term ends, staying "after default in the payment of rent" when "three days' notice, excluding Saturdays and Sundays and other judicial holidays, in writing, requiring its payment" has been served, and staying after failing to perform other lease covenants after a similar three-day notice. Subdivision 6 adds that "A landlord or its agent shall not charge a tenant a fee for serving, posting, or otherwise delivering any notice."

What should be ready before you file?

Keep a copy of the notice as served, how and when each step happened, and the mail date of the mailed copy. If you mailed it Certified, keep the USPS tracking events. Your attorney or the court's self-help center can tell you what the court needs. We don't promise how a court will treat any record.

How do you mail the copy with USMail.ai?

You upload. You approve. We produce. Upload the notice, type the tenant's address, pick Certified Mail or First-Class, check the proof and the full price, and approve. We print, envelope and hand it to USPS. From our own production floor: we print, envelope and hand each piece to USPS, and you see the proof and the full price before you approve. Every address comes from you. We check every address before mailing, and the AI never suggests or adds one. If plans change, you can unapprove an approved job before its mail date, and the money goes back on your meter balance, not your card.

Certified Mail is $1.15 plus the current USPS Certified Mail fee, which USPS publishes in Notice 123. You see the full price before you approve. We don't offer paper Return Receipt yet. Letters starting at $1.15, postage included. For a one-page, single-sided, black-and-white First-Class letter. USMail.ai is an AI print-to-mail platform, not USPS. More California pages are on the California state hub.

What should you keep for your records?

Keep a copy of the notice exactly as you approved it, the date you approved the job, and the mail date. If you chose Certified Mail, save the USPS tracking events as they post. Those records show what you sent and when it went to USPS. They don't prove what the tenant received, and we don't promise how a court will treat them. If you send the same notice to more than one adult on the lease, give each person their own letter with their own name and address, so every record matches one person. Your attorney or your court's self-help center can tell you what to bring if the case goes forward.
